Jury deliberating guilt or innocence in Tyrone McCurdy trial

GREENVILLE — A jury is deliberating guilt or innocence at this hour in the trial of Tyrone Leorone McCurdy, charged with one count of murder connection with a shooting death in Greenville.

McCurdy and Bernard Dale Kelly Jr. both of Greenville, have each pleaded not guilty to one count of murder in connection with the death of Treybbian Leekey Nelson of Greenville.

The jury received the case at around noon today. As of 3:15 p.m., the panel was still engaged in deliberations.



Officers with the Greenville Police Department responded to a call of shots fired in the 1000 block of Edgar Street on the afternoon of February 8, 2011 where they found Nelson had been shot.

The indictments allege McCurdy, Kelly and an unnamed juvenile “knowingly and intentionally” caused Nelson’s death by shooting him with a firearm, or in the alternative, caused Nelson’s death by shooting him or in his direction while having the intent to commit aggravated assault.

McCurdy’s attorney has argued McCurdy acted in self-defense, claiming Nelson had a weapon which was removed from the crime scene before officers arrived.

Kelly currently has trial scheduled in December.
