Date set for new trial in drug possession case

GREENVILLE — A November trial date has been set for a Commerce man, whose conviction and lengthy prison sentence for the possession of methamphetamine were thrown out by the state’s highest criminal appeals court .

Scott Lee James had previously argued, unsuccessfully, that a Hunt County Sheriff’s deputy did not have the authority to make an arrest.

The Texas Court of Criminal Appeals, in an opinion issued in June, ruled James should receive a new trial based on the fact he received ineffective assistance of counsel during his original trial.

During a hearing Wednesday in the 196th District Court, Judge Steve Tittle set a tentative trial date for November 12.
